Ep. 22 – Sovereign Entities, Maine State Fair & Lacrosse Fantasy Leagues
16/10/2017 Duración: 31minCheck in with Brad Sheafe, Chief Intellectual Property Officer (CIPO) and David Pridham, CEO of Dominion Harbor, respectively as they weigh in on the latest IP protection strategy in assigning one’s patent rights to legally protected sovereign entities in a last ditch effort to protect one’s patent rights from the Patent Trial and Appeals Board (PTAB). Specifically, they are directing their attention to the recent Allergan case where they have agreed to pay the St. Regis Mohawk upwards of $15M a year to maintain ownership of their Restasis drug patents in an effort to exclude their scrutiny of both the Federal court system and the PTAB simultaneously. Panel stacking – assigning specific Judges to specific cases in an effort predict or affect a particular outcome. Worse, the USPTO has gone on congressional record admitting to as much with not a hint of remorse or collusion guilt. PTAB – is not an Article III tribunal however it acts as one on ruling over private property issues e.g. Patents

Ep. 21 – More on PTAB, or Moron PTAB, You Decide
03/10/2017 Duración: 27minDavid Pridham and Brad Sheafe explore new revelations at the PTAB that continue to show the odds against the individual inventor remain stacked against them. They speculate about the outcome of Oil States before the Supreme Court (#SCOTUS) challenging the constitutionality of the non-Article III body and how it has chosen to operate. The good news is we have seen a trickle of Federal cases now overturn negative PTAB rulings – so there is hope. The PTAB admitting on the record that it, in fact, stacked the judges to insure a favorable outcome for itself. The judges of the PTAB recently named out of private practice are now sitting before former clients’ cases at the PTAB. The PTAB’s cavalier interpretation of patent law and precedent.

Ep. 20 – Anniversary Episode with Special Marshall Phelps Interview
20/09/2017 Duración: 34minYour hosts, Brad Sheafe and David Pridham are thrilled and privileged to bring you an intimate and illuminating interview with the esteemed Marshall Phelps. About Marshall Phelps Marshall Phelps is one of the leading figures in the field of intellectual property management and performance. He has pioneered many of IP’s leading strategies and best practices, and generated unprecedented results as head of IP business and strategy for IBM in the 1990s and then Microsoft in the 2000s. Ep. 19 – Take Me To Your PTO Leader, Andrei Iancu
20/09/2017 Duración: 15minYour hosts, Brad Sheafe and David Pridham discuss the recent appointment of Andrei Iancu to be the new Director of US Patent Office, or could it be a more sinister Patent Czar? Listen in to learn why. They speculate on his new patent policies and whether he is in a position to begin to reverse so much of the damage to the US patent system inflicted upon us under Michele Lee and the Obama-era administration, starring your favorite tech company to hate, Google, Alphabet or whatever they call themselves these days aside from menacing threat to the individual inventor. From Bio Page of Irell & Manella LLP Andrei Iancu is the Managing Partner of Irell & Manella LLP. Mr. Iancu also practices full time as a member of the litigation and intellectual property practice groups. Mr. Iancu’s practice focuses on intellectual property litigation. He has also been involved in all other aspects of the intellectual property practice, including prosecution, due diligence and licensing. Mr. Iancu is registered to pra

Ep. 18 – Not Dr. Roy on the Attack and Phi Delta Phu
05/09/2017 Duración: 26minTossing offhanded rhetoric about a company’s intentions or motivations without any facts or insights is not proper and it leads to dangerous precedence – primarily with the uninitiated in the IP industry. Readers will just take these labels at face value and render an ill-informed opinion. Dominion Harbor has helps dozens of F500/G2000 companies and equally important individual inventors receive fair value for their inventions. Our advocacy is FOR patent and FOR inventors both directly against infringers, but equally important in the halls of congress and the courtroom. We invite anyone to see how much effort, technical and legal expertise our teams put into determining if we should move forward on an opportunity. Further, we wish we could share all the inbound inquiries from small inventors pleading for us to help them take on much larger firms whom they believe are taking their ideas; the rules are stacked against them and they require experts to help. This is the Techrights story that got the guys to co

Ep. 17 – Google Paying Academics & Being Blocked On Twitter
10/08/2017 Duración: 28minFrom our recent IPWire blog post from Patrick Anderson on Unified Patents’ PTAB win record. As part of our ongoing series to factually expose the patent opposition’s effort of “de-propertization” of patents, I further breakdown Unified Patents as more the devil of patents than Saint Thomas More. Last month, I posted a detailed breakdown of Inter Partes Review statistics relating to petitions filed by self-proclaimed ‘Anti-Troll’ Unified Patents. While I highly recommend you read that post, a few of the highlights for convenience: A paltry 34% institution rate (compared to about 71% for the PTAB overall) An Institution:Denial ratio less than one A substantially higher settlement rate than average Google Buys Academic to Support Their Anti-Patent Agenda The Wall Street Journal article exposing Google for paying for academic research that “independently” supports their anti-patent agenda. 26/07/2017 Duración: 31minDiscussion centers on the uncertainty in the United States patent system and the the “de-propertization” of intellectual property and those organizations that are driving a negative false narrative that patent trolls are ruining the system and the US needs to legislate a new solution. Ep. 15 – Adjustacam LLC v Newegg Attorneys’ Fees or Somali Pirates
17/07/2017 Duración: 30minIP Frequently – where, while always fair, nothing is off limits. We invite you to join the conversation. Today, Brad and David discuss the recent Adjustacam (subsidiary of Acacia Research) v Newegg case where Newegg was awarded legal fees. The also provide some depth on the Somali Pirate problem. Opinion Summary: AdjustaCam, LLC v. Newegg, Inc., __ F.3d __, 2017 WL 2854387 (Fed. Cir. July 5, 2017)(Reyna, J.), the Federal Circuit remanded a patent infringement case to the Texas trial court to grant an award of attorney fees against the patentee in favor of the accused. From the Opinion: “The district court abused its discretion failing to follow our mandate to evaluate the totality of the circumstances under Octane in the first instance. Moreover, [patentee] AdjustaCam filed a weak infringement case against [accused infringer] Newegg that became objectively baseless after the district court’s Markman order. The district court’s determination that AdjustaCam could reasonably argue infringement post-Markma
